CONDITIONS OF  SALE

These General Conditions of Sale are drawn up in Italian and govern the offer and sale of products and / or services on the site  www.fashionbed.it  as well as, for what is not provided for here, the provisions of the Consumer Code and Legislative Decree no. 70/2003 and of the civil code.

The products and / or services purchased on the site are sold directly by  Fashion Bed, with registered office in Italy, Via Cà da Pì 1 (Bergamo); CF  and PI 02039670167.

A. Information about the  conclusion of the sales contract

- These general conditions of sale are an integral and essential part of the purchase contract concluded between you and   Fashion Bed. Your electronic submission of the order implies full knowledge of these General Conditions of Sale and their full acceptance. 

- If you do not agree with one or more terms contained in these General Conditions of Sale, please refrain from making purchases on Fashionbed shop.

- When proceeding with the transmission of the order, you will be warned that such forwarding implies the obligation to pay the indicated price. 

- The purchase contract is to be considered concluded when Fashion Bed receives your order electronically, after verifying the correctness of the data contained therein. 

- Once the purchase contract is concluded, Fashion Bed will process your purchase order by sending an email containing the order summary. However, this email does not constitute automatic acceptance of the order itself. In fact, Fashion Bed reserves the right to refuse orders from customers with whom there is an ongoing dispute relating to the payment of a previous order, who do not give sufficient guarantees of solvency, or which are incomplete or incorrect, or in case of unavailability. of products. In these cases, Fashion Bed will inform you by e-mail that the contract is not concluded and that Fashion Bed has not carried out your purchase order.

B.  Prices

-   All prices published on the Site are expressed in Euros and are inclusive of VAT,  however, they do not include customs fees, import taxes, fees and customs brokerage fees, if applicable based on the destination of the order. In fact, for some destinations, upon arrival at the border of your country, the content of the order may be subject to customs duties (which may include taxes, duties, handling costs, remuneration of customs brokers, etc.), the payment of which is at your expense, as the customer receiving the order.

-   Fashion Bed reserves the right to change the price of the products at any time and also, possibly, several times during the same day, it being understood that the price charged to the customer will be that indicated on the Site at the time of placing the order. and that any changes (increase or decrease) subsequent to the transmission of the same will not be taken into account.

C. Methods  of payment

The payment of the Products purchased on the Site can be made using the payment methods described in the following paragraphs. Some payment methods may not be usable due to the type of Product purchased and / or the method of delivery or shipment. The payment methods actually available to the customer in relation to the individual Product will be specifically indicated during the purchase procedure.

1) Credit card

​

The payment of the Products purchased on the Site can be made by credit card directly through the Site. The credit cards accepted by Fashion Bed will be specifically indicated on the payment method page. For payment using some credit cards, an additional fee may be required. The request for this contribution and the exact amount of the same will be, if due, clearly and specifically indicated on the page for choosing the payment method during the purchase procedure.

- In the case of payment by credit card, at the same time as the conclusion of the contract, the issuer of the reference card will authorize only the commitment of the amount relating to the purchase made ("Authorization"). The Total Amount Due in relation to the purchased Product will actually be charged to the customer's credit card at the time of shipment of the purchased Product.

- In all cases of termination of the contract and consequent cancellation of the order before the actual debit on the customer's credit card, Fashion Bed will request the issuer of the reference card to release the amount committed through the banking systems. The release times depend exclusively on the credit card issuer and, for some types of cards, they can reach their natural expiry which is normally 24 days from the date of the Authorization.
Once the issuer of the reference card has been requested to release the amount committed, in no case Fashion Bed can be held responsible for any damage, direct or indirect, caused by the delay in the release and / or the failure to release the amount committed by part of the banking system.

- If, after the actual debit of the total amount due on the customer's credit card, the contract is terminated, with consequent cancellation of the order, Fashion Bed will re-credit the total amount due without undue delay and, in in any case, within 14 days from the termination of the contract.

- At no time during the purchase procedure is Fashion Bed able to know the information relating to the customer's credit card, transmitted, via a secure connection, directly to the card issuer's site. No Fashion Bed computer archive stores such data, except, limited to the data relating to the card holder, the case referred to in the preceding paragraph.

2) Paypal

​

- The payment of the Products purchased on the Site can be made through the PayPal payment solution, based on the terms and conditions of the contract agreed between the customer and PayPal. In the case of payment by PayPal, the amount relating to the purchase made will be charged by PayPal immediately, at the same time as the conclusion of the contract.

-  In all cases of termination of the contract and consequent cancellation of the order, the total amount due will be simultaneously credited back to the customer's PayPal account. The methods of re-credit on the payment instrument connected to the PayPal account depend exclusively on PayPal. Once the amount relating to the purchase made on the PayPal account has been credited, in no case Fashion Bed can be held responsible for any direct or indirect damages caused by delays in the actual crediting attributable to PayPal or the banking system.

- The data entered on the PayPal site will be processed directly by the same and will not be transmitted or shared with Fashion Bed. Fashion Bed is therefore unable to know and does not store in any way the data of the credit card connected to the customer's PayPal account or the data of any other payment instrument connected with this account.

D. Delivery methods

​

You can choose to have your order delivered to the address of your choice, or to your office.

Once the order has been placed, it is no longer possible to change the shipping address.

Remote Zone

For some areas that couriers classify as "remote areas" an additional transport contribution of € 6.00 is required. The interested parties will be immediately notified via email as soon as we receive the order.

Furthermore, in these locations, some services (such as those of Delivery AL FLOOR, or AT HOME) are not available.
The locations classified as remote areas are as follows:

Delivery to the localities of Livigno (ZIP code 23030) and Campione d'Italia (ZIP code 22060) is excluded.

AND.  Right of withdrawal  

- As a customer, you can withdraw from the purchase contract concluded with Fashion Bed without any penalty and without specifying the reason, within fourteen (14) days, starting from the day of receipt of the products purchased in the manner indicated below.

- Before the expiry of the withdrawal period as determined above, you can make the return request directly from the Fashionbed  shop by filling out the request in the contact section and forwarding the return request to Fashion Bed. Alternatively, by means of another explicit declaration of your decision to withdraw from the contract, to be communicated to Fashion Bed through an email addressed to  info@fashionbed.it  which includes the details of your purchase, the date it was ordered or received and your name and address.

-   As a Customer, you must return the goods or deliver them to the third party authorized by Fashion Bed to receive the goods, without undue delay and in any case within fourteen days from the date on which you notified Fashion Bed of your decision to withdraw from the contract. The deadline is met if you send back the goods before the fourteen-day period has expired.

-  Shipping and return costs remain the responsibility of the buyer, except for current promotions specified on the site  coccoy.it at the time of purchase.

- After returning the products, Fashion Bed will make the necessary checks regarding their compliance with the conditions and terms indicated in this section.

- If the right of withdrawal is exercised following the methods and terms indicated in this paragraph, Fashion Bed will refund you any sums already collected for the purchase of the products.

- Whatever the payment method you use, the refund is activated by Fashion Bed in the shortest possible time and in any case within fourteen (14) days from the day you notified Fashion Bed of your decision to withdraw from the contract. Fashion Bed may withhold the refund until it has received the products, or until you have demonstrated that you have returned the products, whichever occurs first.

- Fashion Bed will make the refund using the same payment method you used for the purchase of the returned products, even if a virtual and / or disposable credit card has been used. For legal reasons Fashion Bed will in no way be able to make a refund on a credit card other than the one used for the purchase, except in the case in which the credit card itself has expired in the meantime: in this case you can send a e-mail to  info@coccoy.it  to agree on the most appropriate means of reimbursement.

F.  Purchases on the Site

- The purchase of the Products on the Site is allowed only to those who have reached the age of 18.

- The purchase of the Products on the Site is allowed both to customers who have the quality of consumers and to customers who do not have this quality. Pursuant to art. 3, I comma, lett. a) of the Consumer Code, the consumer is the natural person who acts for purposes unrelated to any entrepreneurial, commercial, professional or craft activity carried out. The inclusion of the VAT number during the purchase procedure is considered to indicate that the purchase has been made for purposes related to the entrepreneurial, commercial, craft or professional activity carried out.

- In case of violation of the prohibitions contained in the current article, Fashion Bed reserves the right to take all necessary actions to stop the irregularities, including the suspension of access to the site, the cancellation of the registration or the non-acceptance or cancellation of orders.

- The Site is constantly updated automatically in order to ensure maximum correspondence between the availability communicated by the suppliers and those indicated on the Site.

However, it may happen, also due to the possibility that several users purchase the same Product at the same time, that the ordered Product is no longer available after the transmission of the purchase order. In this case, without prejudice to the rights attributed to the customer by law and, in particular, by Chapter XIV of Title II of Book IV of the civil code, the customer will be promptly informed by e-mail and will therefore be entitled to immediately terminate the contract, without prejudice to the right to compensation for damage, pursuant to and by effect of the provisions of art. 61, IV and V paragraphs, of the Consumer Code. The customer who has already made the payment (see the Payment Methods section), will be promptly refunded the total amount paid, including delivery costs and any other costs incurred, in relation to the order itself ("Total Amount Due" ).
